Welcome to eBasket! These Terms and Conditions ("Terms") govern your use of the eBasket mobile application and website operated by eBasket("Company", "we", "us", or "our"). Please read these Terms carefully before using our services. By accessing or using eBasket, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the eBasket app or accessing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services. You must be at least 18 years old to use our services.

2. Account Registration

To use our services, you must register an account using your mobile phone number. You will receive a One-Time Password (OTP) for verification. By registering, you agree to:

• Provide accurate and current information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

3. Ordering & Pricing

All orders placed through the eBasket app are subject to the following conditions:

• Product prices are displayed in Indian Rupees (INR) and include applicable taxes unless otherwise stated
• Prices may vary and are subject to change without prior notice
• Products are subject to availability. In case of stock-outs, we may suggest alternatives or issue a refund
• We reserve the right to limit order quantities for specific products
• Promotional offers and discounts are subject to specific terms and may be modified or withdrawn at any time

4. Payment Terms

We accept the following payment methods:

• Cash on Delivery (COD): Pay in cash when your order is delivered to your doorstep
• Online Payments: UPI, debit/credit cards, net banking, and digital wallets through our secure payment gateway

All online payments are processed through secure, PCI-DSS compliant third-party payment gateways. We do not store your payment card details on our servers.

5. Delivery Policy

We strive to deliver your orders as quickly as possible. Please note:

• Our target delivery time is 10-20 minutes, but this is an estimate and not a guarantee
• Delivery times may vary based on order volume, weather conditions, traffic, and other factors
• Delivery is available only within our serviceable area. You will be notified if your location is not currently serviceable
• Delivery charges, if any, will be clearly displayed at checkout before you place the order
• You must be available at the delivery address to receive your order. If the delivery partner is unable to reach you, the order may be cancelled

We are committed to delivering only fresh and quality products. All perishable items are stored and handled under appropriate conditions. If you receive a product that does not meet quality standards — including damaged, expired, or spoiled items — please report it through the app within 24 hours. We will arrange for a replacement or refund at no additional cost. Product images on the app are representative; actual products may vary slightly in appearance.

8. User Responsibilities

As a user of eBasket, you agree to:

• Provide accurate and complete delivery addresses
• Be available at the delivery address to receive your order, or designate someone to receive it on your behalf
• Treat our delivery partners with respect and courtesy
• Not misuse the app, create fraudulent orders, or abuse promotional offers
• Not use the service for any unlawful purpose
• Not attempt to reverse-engineer, decompile, or modify the app

9. Intellectual Property

All content, trademarks, logos, graphics, software, and other materials on theeBasket app and website are the intellectual property of eBasket or its licensors. You may not reproduce, distribute, modify, or create derivative works from any of our content without prior written permission. The eBasket name, logo, and branding are registered trademarks of eBasket.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• eBasket shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services
• Our total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim
• We are not liable for delays or failures caused by events beyond our reasonable control (force majeure), including natural disasters, strikes, or government restrictions

11. Modification of Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated "Last updated" date. We may also notify you of significant changes via the app or SMS. Your continued use of eBasket after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts in Tapi District, Gujarat, India.

13. Dispute Resolution

We believe in resolving disputes amicably. If you have any concerns or disputes regarding our services, please first contact our customer support team. We will make every effort to resolve the matter informally within 15 business days. If the dispute cannot be resolved through discussion, either party may pursue legal remedies as outlined in the Governing Law section above.

14. Account Deletion

You may delete your eBasket account at any time using either of the following methods:

• Self-service via the app: Go to your Profile screen in the eBasket app and select "Delete Account". Follow the on-screen confirmation steps to permanently delete your account and all associated data.
• Email request: Send a deletion request to support@ebasket.in with your registered mobile number. We will verify your identity and process the deletion within 30 days.

Account deletion is permanent and irreversible. All personal data, order history, saved addresses, and payment records will be removed. Pending orders, if any, must be completed or cancelled before account deletion can be processed. Data required for legal or tax compliance may be retained as mandated by applicable law.

15. Delivery Partner Terms

If you register as a delivery partner through the eBasket Delivery Partner app, the following additional terms apply:

• Delivery partners are independent contractors and not employees of eBasket
• You must provide valid identification, a valid driving license (where applicable), and accurate personal information during onboarding
• Delivery partners must handle all products and orders with care, ensuring timely and safe delivery
• Compensation, incentives, and payout terms are as communicated within the delivery partner app and may be revised from time to time
• We reserve the right to deactivate delivery partner accounts for misconduct, fraud, or violation of these terms
• Delivery partner account deletion follows the same process as described in Section 14 above

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
